TAPEONLINE PHOTO CONTEST OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. U.S. ONLY. VOID WHERE PROHIBITED. FOR PERSONS WHO ENTER THE CONTEST, THESE RULES GOVERN ALL ASPECTS OF PARTICIPATION AND PRIZE AWARD.
The TapeOnline Photo Contest is sponsored by Electric Picture Company, Inc. d/b/a TapeOnline, P.O. Box 110353, Nashville, Tennessee 37222 ("TapeOnline"). Four prizes will be awarded. One prize will be awarded to each of three participants whose entries receive the highest number of votes. One Grand Prize will be awarded at TapeOnline's discretion based on the "most interesting" photo submission as determined by TapeOnline.
No Purchase Necessary to Enter or Win. This is a contest based upon skill and creativity; winning is not based upon chance.
Timing. The Contest begins August 14, 2008 at 10 am. U.S. Central Time and ends October 13, 2008 at 5 pm. Central Time ("Contest Period").
Eligibility. This contest is open only to legal residents of the United States residing in the continental United States and Hawaii. Entrants must be 18 years or older as of the beginning date of the Contest Period. Employees of TapeOnline and its affiliates and their immediate family members, and individuals residing in the same household as such employees, are not eligible to participate (whether as an entrant or a voter) in this contest. This contest is void where prohibited by law and is subject to all applicable federal, state, and local laws and regulations. By participating, entrants agree to these official rules and agree to accept all decisions of TapeOnline with respect to this contest as final.
Requirements. Entrant must sign up for a TapeOnline.com user account (at no cost) to be able to submit photos to and enter the contest. Entrants may sign-up for a TapeOnline.com user account at https://www.tapeonline.com/authenticate.aspx or by calling 877.893.8273.
How to Enter:
Online: Go to http://www.tapeonline.com/photo-contest/submit.aspx and upload a photo illustrating a creative use/depiction of a product sold by TapeOnline.
Voting Process: Once a photo has been submitted, users can vote for that photo by using the voting button located next to each photo. The three photos with the most votes on October 13th, 2008 at 5 pm Central Time will be declared the winners. The three entrants who have submitted the photos with the most votes will win a prize. One prize per entrant. If one entrant holds more than one winning entry, the photo with the next highest vote tally submitted by a different entrant will be awarded a prize.
Acceptable Entries: An acceptable entry must be: (i) Entirely the original creation of the entrant; (ii) Taken or created during the contest period; (iii) Submitted in digital format (the image may be taken with a camera or created by other means); and (iv) Include the image of a product sold by TapeOnline as used or displayed in a creative manner (No purchase is required and entrants of the contest shall be permitted a limited right to use TapeOnline's digital product images located at www.tapeonline.com to create an entry).
Unacceptable Entries: An acceptable entry may not contain (as determined in TapeOnline's sole discretion): (i) Any obscene, provocative, sexually explicit or otherwise objectionable or inappropriate images; and (ii) The image of any child under the age of 18.
Photo Moderation Period: Once submitted, photos will not be immediately displayed on TapeOnline.com, but instead enter a moderation period to determine whether the photo meets the requirements as stated in these contest rules. Once the photo has completed the moderation period, the photo will either be displayed on the TapeOnline.com website or disqualified and discarded.
Any entry that does not meet the criteria below or otherwise comply with these rules may be disqualified in the sole discretion of TapeOnline.
Entry must be Original. By entering the contest, entrant represents and warrants that the submitted entry is an original work created solely by the entrant, that the photograph does not infringe upon the copyrights, trademarks, rights of privacy, publicity or intellectual property rights of any person or entity and that no other party has any right, title, claim or interest in the photograph.
Assignment of Entries. All entries become the exclusive property of TapeOnline. Proof of sending or submission will not be deemed to be proof of receipt by TapeOnline. TapeOnline is not responsible for lost, late, incomplete, invalid, unintelligible, illegible or misdirected entries, which will be disqualified. Use of any automated system or agent to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any entry, the entry will be disqualified. The potential winners may be required to show proof of being the authorized account holder.
Releases. If any persons appear in the photograph, the entrant is responsible for obtaining any and all releases and consents necessary to permit the publication and use of the photograph in a manner set forth in these official rules without any additional compensation. As a condition of winning, an entrant must provide a signed written personal release from all persons who appear in an image submitted, and/or from the copyright owner of any artwork or other copyrighted material that appears in the entry, authorizing use of the photograph in TapeOnline's marketing and promotional materials in any and all media.
Voting. During the Contest Period, any person (except for non-eligible persons discussed above) may vote for an entry by casting a vote for such entry at http://www.tapeonline.com/photo-contest/gallery.aspx. Any user attempting to use an automated system or agent to increase vote tallies or to acquire more than one vote per photo per day is prohibited and will result in disqualification of the affected entry and possible ban from access to TapeOnline.com website. The three entries receiving the most votes at the end of the contest will be selected as winning entries.
Selection of Potential Winners. On October 13th, 2008 at 5 pm Central Time, TapeOnline will tally votes from all eligible entries received during the Contest Period and awarded one of the prizes described below. At this time the Grand Prize winner will also be determined at TapeOnline's discretion based on the "most interesting" photo submission as deemed by TapeOnline. Entrants selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by e-mail, phone or mail within 14 days of the conclusion of the Contest Period. If a potential winner cannot be contacted within 14 days of the first attempt to contact him/her, he/she will be disqualified, and an alternate entrant will be selected. All winners will be subject to verification and must meet all eligibility requirements before a prize is awarded.
Prizes. Winners of the voting process will receive one (1) of the following: (1) Nintendo Wii gaming system, MSRP $249.99; One (1) LaCie Rugged Hard Drive, MSRP $239.99; or One (1) Sony CyberShot Digital Camera, MSRP $249.99. The Grand Prize winner will receive One (1) Apple iPod Touch MP3 Player, MSRP $299.00. The photo with the most votes at the end of the contest period will receive one (1) Nintendo Wii gaming system, MSRP $249.99. Winners are solely responsible for any and all applicable fees associated with prize use. Winners may not choose their prize. Prizes may be substituted at any time.
License. Each entrant grants to TapeOnline, and its successor, licensees and assigns, the perpetual and irrevocable right to use his or her name and city of residence in connection with the entry in any and all advertising and promotions as determined in TapeOnline's sole discretion, in any and all media, whether now existing or hereafter devised, throughout the world.
General Conditions. TapeOnline reserves the right to cancel, suspend and/or modify the Contest if fraud, technical failures or any other factor beyond TapeOnline's reasonable control impairs the integrity of the Contest, as determined by TapeOnline in its sole discretion. TapeOnline reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage TapeOnline's website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and, should such an attempt be made, TapeOnline reserves the right to seek damages from any such person to the fullest extent permitted by law. TapeOnline's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Release and Limitations of Liability. By participating in the Contest, entrants agree to release and hold harmless TapeOnline, its respective officers, directors, employees, parent companies and agents from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Contest or the processing of entries; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action, TapeOnline's liability will be limited to the cost of entering and participating in the Contest, and in no event shall TapeOnline be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved under the laws of the State of Tennessee, U.S.A., without respect to any conflict of law issues, and entrant agrees that such shall be resolved individually, without resort to any form of class action, and exclusively by the U.S. Federal and State Courts of Davidson County, Tennessee, U.S.A.
Right to Cancel or Suspend Contest. If, for any reason, the contest is not capable of running as planned due to computer disruptions, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of TapeOnline, which affects the administration, security, fairness, integrity, or proper conduct of this contest, TapeOnline reserves the right, at its sole discretion, to disqualify any individual(s) and/or to cancel, terminate, modify, or suspend the contest. If TapeOnline elects to cancel or terminate the contest, TapeOnline will not retain any rights to the submitted photographs.

Winners List. The name and city and state of residence of each entrant and winner will be posted on TapeOnline's web site at http://www.tapeonline.com/photo-contest/.
